Terms of service
These Terms of Service (the "Terms") govern your access to and use of customclearancebars.com (the "Site") and the purchase of custom-manufactured clearance bars and related products (collectively, the "Services") offered by Fourth Dimension CNC, doing business as Custom Clearance Bars ("we," "us," or "our"). Please read them carefully. They contain important provisions including a binding arbitration clause, a class-action waiver, disclaimers of warranty, and a limitation of liability.
1. Acceptance of terms
By accessing the Site, creating an account, submitting a configuration, or placing an order you agree to be bound by these Terms and by our Privacy Policy, Return & Refund Policy, and Shipping Policy, which are incorporated by reference. If you do not agree, do not use the Site or place an order.
2. Who we are; jurisdiction
Fourth Dimension CNC is a United States company operating the Custom Clearance Bars storefront. These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Exclusive venue for any dispute that is not subject to arbitration (see Section 13) is the state and federal courts located in Minnesota, and you consent to personal jurisdiction there.
3. Accounts
You may browse the Site and place guest orders without an account. To track orders, save configurations, or access business features you must create an account. You agree to provide accurate, current, and complete information; to keep your login credentials confidential; to be responsible for all activity under your account; and to notify us promptly of any unauthorized access. Accounts are for a single person or business entity. You may not share credentials or transfer your account without our written consent.
4. Custom-manufactured products — non-returnable
Every clearance bar we ship is custom manufactured to your specifications (length, diameter, color, reflective options, custom text, hardware). Because these items are built to order and cannot be resold, they are not returnable or refundable for change of mind, misordered size, misselected color, or customer typos in the custom text, once production has started.
We stand behind the quality of our work. If your bar arrives with a genuine manufacturing defect — wrong dimensions, wrong color from what you ordered, damaged in shipping, or a workmanship defect — we will remake the bar or issue a refund at our discretion. The full defect policy, reporting window, and required evidence are described in our Return & Refund Policy.
By placing an order you acknowledge that you have reviewed your configuration (dimensions, color, text, and hardware selections) before submitting payment and that you accept the non-returnable nature of custom goods.
5. Pricing and payment
Prices shown on the Site's configurator are estimates for your convenience. The authoritative price for your order is the amount presented at Stripe checkout, which is calculated server-side at the moment of payment. We reserve the right to correct pricing errors and to cancel any order that resulted from a pricing mistake, refunding any amount charged. Sales tax is calculated at checkout based on the shipping destination, and LTL freight delivery is priced and charged as described in the Shipping Policy. Payment is processed by Stripe, Inc.; we do not see or store full card numbers.
Business accounts we approve for invoice terms may instead place orders on invoice, up to the credit limit we set. Each invoice is due within the terms stated on the account (Net 15, 30 or 60 days from the invoice date). We may pause or withdraw terms, for example when an invoice is past due; orders already invoiced stay payable on their original terms.
6. Lead time and shipping
Production timing is confirmed with your delivered quote. Production begins after payment and specification approval (see the Shipping Policy for details). Lead-time estimates are good-faith estimates and are not guarantees. We are not liable for delays caused by carriers, customs (if applicable), acts of God, supplier failures, labor actions, or any cause outside our reasonable control. Risk of loss passes to you upon tender of the shipment to the freight carrier at our facility, subject to the shipping-damage procedure in the Shipping Policy.
7. Intellectual property
All content on the Site — including our logo, trademarks, product images, 3D models, configurator code, copy, and the "Custom Clearance Bars" name — is owned by Fourth Dimension CNC or its licensors and is protected by United States and international copyright, trademark, and other laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Site without our prior written permission, except as expressly permitted by these Terms.
If you upload artwork, text, logos, or color samples for use on your bar, you represent and warrant that you own or have the necessary rights to that content and that it does not infringe any third-party rights. You grant us a non-exclusive, royalty-free, worldwide license to reproduce, modify, and incorporate that content solely for the purpose of manufacturing your order and maintaining production records.
8. Prohibited uses
You agree not to:
- Resell our products without our written authorization as an approved reseller or distributor.
- Reverse engineer, decompile, or attempt to extract the source code of any part of the Site.
- Access the Site by automated means (bots, scrapers, crawlers) except for public search-engine indexing.
- Interfere with or disrupt the Site's operation, security, or network infrastructure.
- Use the Site to transmit malware, unlawful content, or content that infringes another party's rights.
- Submit a false name, stolen payment method, or fraudulent order.
- Use custom text or artwork that is obscene, defamatory, threatening, harassing, or promotes violence, discrimination, or illegal activity. We reserve the right to refuse any order containing such content without refund of work already performed.
9. Warranty disclaimer
Except as expressly provided in the Return & Refund Policy, the Services and products are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses. Some jurisdictions do not allow the exclusion of implied warranties, so portions of this disclaimer may not apply to you.
Clearance bars are safety warning devices. They alert drivers to approaching low-clearance situations; they are not impact-rated barriers and are not designed to stop a moving vehicle. You are responsible for installing the bar at the correct height and in compliance with all applicable building codes and insurance requirements.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Fourth Dimension CNC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, loss of goodwill, business interruption, or cost of substitute goods, arising out of or in connection with these Terms, the Services, or the products, whether based on contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim and (b) one hundred United States dollars ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Fourth Dimension CNC and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Services or products, (c) artwork, text, or other content you supplied, or (d) your violation of any law or the rights of a third party.
12. Termination
We may suspend or terminate your access to the Site or your account at any time for any reason, including for breach of these Terms, suspected fraud, abusive behavior, or for our own business reasons. Upon termination, provisions that by their nature should survive — including Sections 7, 9, 10, 11, 13, 14, and 15 — will continue in effect.
13. Dispute resolution — binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the products — except for claims you or we may bring in small-claims court, or for injunctive relief to protect intellectual property — shall be resolved by final and binding arbitration administered by a nationally recognized arbitration provider under its then-current commercial rules. The arbitration shall be conducted in Minnesota, in the English language, by a single arbitrator. The arbitrator's award shall be final and may be enforced in any court of competent jurisdiction. Each party shall bear its own costs except as otherwise ordered by the arbitrator.
14. Class-action waiver
You and we agree that each party may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
15. Governing law
These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Minnesota and the Federal Arbitration Act (for Section 13), without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
17. Entire agreement
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us concerning your use of the Site and purchase of products, and supersede all prior or contemporaneous communications on the same subject.
18. Changes to these terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top. For material changes, we will provide at least 30 days' notice via email or a site banner before the change becomes effective. If you do not agree to the revised Terms, you must stop using the Services; continued use after the effective date constitutes acceptance.
